General Property Information

Head, Transport for Victoria (HTV) owns numerous freehold properties across Victoria for future transport requirements. Department of Transport and Planning (DTP) is the administrative body appointed to manage HTV assets.

BGIS is the managing agent appointed to manage HTV owned future transport use land. However, BGIS does not manage land associated with the road network including the road surface, reserve which is adjacent to arterial roads or freeways, current or future transport infrastructure projects or land sales/acquisition matters – these are all managed by DTP directly.  If your query relates to the road network or road reserve land, please contact DTP directly.

Please note that DTP is not responsible for all roads, only freeways and arterial roads with local councils managing municipal roads.  These can be identified by viewing the MAP OF DTP MANAGED ROADS.

Dividing Fencing Enquiries

DTP manages two forms of land that may share a fence line with private property owners:

  1. A road reserve, which is adjacent to arterial roads or freeways and has the same status as the adjoining road; and
  2. “Land in title”, which is land that has been acquired or purchased by HTV for future road or transport projects.

 

Fencing Obligations – Roads and Road Reserve

Under Schedule 5, Section 4 of the Road Management Act 2004, DTP is not responsible for all roads, only freeways and arterial roads. These can be identified by viewing the Map of DTP managed roads.

If the fence is adjacent to an arterial road or freeway, the land will be classed as road reserve and will have the same status as the road, therefore the adjacent land owner is responsible for the whole cost of the fence.  If the road is not a freeway or an arterial road, contact your local council to establish the status of the road and fencing responsibilities.

Fencing Obligations – Freehold Land (Not Road)

If the land is owned by HTV or the former Roads Corporation as “land in title” otherwise known as freehold, then DTP is responsible for sharing half of the cost of the fence, subject to the following requirements, as set out in the Fences Act 1968.

The adjacent land owner is to obtain two quotes for a 1.6M – 1.8M paling wood fence (treated pine). The quotes should be forwarded to BGIS who may obtain a third probity quote and will arrange for review/approval of the fencing works. Any additional requirements (colour bond, higher height fence etc) will need to be noted separately on the quote and the adjacent land owner will be responsible for these costs. Please note that gates providing access to DTP land are not permitted under any circumstances. An agreement on the quote and contractor to be used will then be reached between the adjoining land owner and BGIS on DTP’s behalf.

Once the fence quote has been agreed and the works completed, an invoice for 50% of the total cost should be forwarded to BGIS for review and payment.

Freehold (Land in Title) Dividing Fence Management Process

Where HTV owns freehold land, DTP is responsible for sharing half of the fence cost with the adjoining land owner subject to the following requirements and the Fences Act 2014.

  • The adjacent land owner is to provide BGIS a request to repair/replace the dividing fence with the following:
  1. Two (2) Compliant Quotes (see definition below) from two (2) Acceptable Contractors (see definition below).
  2. Copies of contractor insurances, evidence of ABN, licences and working rights status, SWMS and HSE documentation (if requested).
  3. Photographs of the existing fence requiring replacement to BGIS as agent for DTP
  • Should the adjoining land owner desire a higher standard of fencing product (ie colourbond, increased height etc), the additional cost for this must be separately itemised on the quotes. DTP will not contribute to the cost of a higher standard of fencing product.
  • BGIS may obtain a third Compliant Quote from an Acceptable Contractor before submitting all quotes and supporting documentation to DTP for approval.
  • Once DTP have approved a quote, BGIS will advise the adjoining land owner which quote and contractor has been approved to proceed together with any special instruction and/or requirements.
  • Once the fencing works have been completed, the successful contractor and/or adjoining land owner must provide the following to BGIS:
  1. Photographs evidencing completion of the fencing works.
  2. A valid Tax Invoice to Department of Transport and Planning c/- BGIS for 50% of timber paling fence and vegetation removal costs.
  3. A valid Tax Invoice to the adjacent land owner for 50% of timber paling fence and vegetation removal costs plus any higher fencing standard or additional items.

Note: DTP via BGIS is only able to pay the contractor and will not reimburse the adjacent land owner.

  • BGIS will arrange payment of the contractor’s Tax Invoice within 30 days of receipt of all required completion documentation. Note: BGIS may engage a sub-contractor to liaise / manage the successful contractor including payment of the DTP share of the fencing cost.

 

Definitions

A Compliant Quote means a written quote on contractor letterhead clearly outlining:

  • The cost for supplying and installing a 1.8 m high single timber paling (treated pine) fence.
  • Includes the installation of fencing posts concreted to 600 mm depth.
  • Any vegetation removal / other access costs are to be separately itemised.

An Acceptable Contractor means:

  • A contractor with a registered ABN including registration for GST.
  • A contractor with valid Certificates of Currency for Public Liability and Professional Indemnity insurance to the value of $20,000,000 for each occurrence.
  • A contractor with valid Workers Compensation insurance (not required for a sole trader).

Information for Fencing Contractors (Freehold / Land in Title) Dividing Fence Management

BGIS is engaged by DTP to manage its properties including management of dividing fences on freehold owned properties. BGIS does not have the capacity to onboard numerous fencing contractors into its systems quickly and therefore engages ADIT Services Pty Ltd (ADIT) to manage fencing sub-contractor  engagement for approved quotes, work management and payment of DTP’s share of the fencing sub-contractor’s quote.

In order to comply with BGIS’ safety and works integrity requirements, ADIT will require the successful fencing contractor to:

  • Provide copies of their Insurance Certificates of Currency for Public Liability ($20,000,000 for each occurrence), Professional Indemnity and Workers Compensation.
  • Provide details of their company/business including ABN, licences, working rights status, copies of SWMS and other Workplace Health & Safety documentation (as appropriate).
  • Have all staff who will be attending site to undertake works complete an online BGIS Induction through its Avetta system 48 hours prior to attending site.
  • Have all staff who will be attending site for the works download and use BGIS’ safe work application BSAFE through to final completion of the job in the system.
  • Invoice ADIT for DTP’s share of the approved quote.

Approved fencing sub-contractors must attend to the above items in order to be compliant and be paid for the works completed. The fencing sub-contractor is to liaise with the adjoining property owner for the payment of their share of the approved quote.

Note that DTP will pay their 50% share of the following works:

  • Supply and installation of a 1.8m high single timber paling (treated pine) fence.
  • Supply and installation of fencing posts concreted to 600mm depth.
  • Removal of vegetation / access arrangements relating to its land only.

Any additional costs such as a higher standard of fencing product (ie colourbond, increased height etc) and vegetation removal / access arrangements for the adjoining owner’s land must be separately itemised and paid for by the adjoining owner – DTP will not contribute to these costs.
